Prime Minister signed an instruction regarding the law on voluntary association of territorial communities
MARCH 25, the AUC received an instruction from A. Yatsenyuk, Prime Minister of Ukraine “Concerning the Law of Ukraine # 157-VIII “On Voluntary Consolidation of Territorial Communities” of February 05, 2015.
In particular, the Prime Minister gave a task for H. Zubko, Vice Prime Minister, A. Abromavichus, Minister of Economy, N. Yaresko, Minister of Finance, and P. Petrenko, Minister of Justice, to prepare, in cooperation with Ukraine-wide local government associations, draft regulatory documents of the Cabinet of Ministers to describe the methodology for providing subventions from the National Budget to consolidated territorial communities and mechanisms for the formation of capable territorial communities.
In addition to this, heads of oblast state administrations have been charged with the task to prepare, in cooperation with chairmen of the corresponding oblast councils, the long-term perspective plans for the formation of the territories of new communities and submit these documents to the Cabinet of Ministers for consideration in the due manner.
Background. DIALOGUE Project experts together with specialists of the Ministry of Regional Development were involved in the preparation of the Methodology for the formation of capable territorial communities. On March 19, the AUC concurred with the draft Methodology in the due manner.

MARCH 19, the Ministry of Regional Development sent to the AUC the draft resolution of the Cabinet of Ministers, which approves the Methodology for the formation of capable territorial communities. The document also has a tasker for oblast state administrations to develop with one month long-term perspective plans for the formation of communities. In addition to this, the resolution also approves the format of the profile of eth capable territorial community.
In the opinion of DIALOGUE Project experts, the draft resolution of the Cabinet of Ministers reflects the position of the Association. The AUC concurred with the text of the resolution without reservations in the due manner.
The Methodology for consolidation of communities is being prepared with the participation of DIALOGUE Project experts
MARCH 16, Experts of the AUC Center for Analysis and Legislation Drafting in cooperation with specialists of the Ministry of Regional Development conducted a working session to elaborate the Methodology for the formation of capable territorial communities.
The draft document reflects proposals from the DIALOGUE Project. The document was submitted to the leadership of the Ministry of Regional Development for the preparation of the corresponding resolution.
Expert Group on decentralisation, local government reform discussed the Methodology for the Formation of Capable Territorial Communities
MARCH 10, M.Pittsyk, Executive Director of the AUC, participate in the working session of the Expert Group on decentralisation, local government reform and regional policy established at the Ministry of Regional Development and headed by H. Zubko, Vice Prime Minister.
The purpose of the event was to present and discuss the Methodology for the Reformation of Capable Territorial Communities.
The Methodology was prepared by experts of the Ministry of Regional Development in cooperation with DIALOGUE Project experts. According to the document, the potential centers for the future capable communities will be: oblast significance cities, current rayon centers, rayon significance cities and populated areas, which historically have had the status of oblast significance cities, and other populated areas with the best developed infrastructure.
In addition to this, the document has the following chapters:
- Boundaries of territories of community jurisdictions
The Main Principle – ubiquity, i.e. all the territory should be divided between territorial communities without gaps (now “grey areas”);
- requirements for the preparation of the Long-Term Perspective Plan for the formation territories of new communities
The Plan should consist of two parts – the graphical one (boundaries of communities, their administrative centers, and all populated areas in them) and the text one – “community profile” (description of the capable territorial community);
- methodology for the approval of the long-term perspective plan
The plan will be prepared by oblast state administrations, it will be approved by the corresponding oblast councils and endorsed by the Cabinet of Ministers.
The approval of the Methodology is the first step towards the implementation of the Law “On Voluntary Consolidation of Territorial Communities”. All in all, there will be four stages: approval of the Methodology; approval of the Long-Term Perspective Plan for the formation of the communities in the oblast; consolidation of territorial communities in accordance with the Long-Time Perspective Plan; and, formation of local government bodies in new consolidated communities.
The members of the Expert Group supported the presented Methodology in general and emphasised the need to endorse the document by the resolution of the Cabinet of Ministers as soon as possible.All news
